1. Acceptance of Terms

By downloading, installing, accessing, or using TopTenify ("the App," "Service," "we," "us," or "our"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and TopTenify. Your use of the App is also governed by our Privacy Policy.

We reserve the right to modify these Terms at any time. Material changes will be communicated through in-app notifications or email.

2. Nature of the Service

Opinion Platform: TopTenify is a community-driven platform for creating, sharing, and debating subjective, opinion-based rankings and lists.

3. Account Registration

• You must be at least 13 years old (or 16 where GDPR applies) to create an account
• You may register through Apple Sign-In, Google Sign-In, or guest access
• You are responsible for maintaining the confidentiality of your account credentials
• You agree to provide accurate information and keep it updated
• One account per person; multiple accounts are prohibited

4. User Content

• You retain ownership of content you create and submit
• By submitting content, you grant TopTenify a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content within the App
• You are solely responsible for all content you submit
• Content must comply with our Community Guidelines
• We reserve the right to remove content that violates our policies

5. Prohibited Conduct

• Vote manipulation, coordinated voting campaigns, or gaming the ranking system
• Harassment, hate speech, threats, or bullying of any kind
• Posting illegal, obscene, or harmful content
• Impersonating other users or public figures
• Spam, advertising without authorization, or phishing
• Attempting to access accounts or data belonging to others
• Using bots, scripts, or automated tools to interact with the App
• Circumventing security measures or exploiting vulnerabilities
• Violating any applicable laws or regulations

6. Gamification System

TopTenify features a gamification system including Clout Points, ranking tiers, levels, achievements, streaks, and Arena games. These are for entertainment purposes and have no monetary value. We reserve the right to modify the gamification system at any time.

7. Sponsored Content and Payments

• Sponsored content and promoted submissions are clearly labeled
• Payments are processed through Stripe and subject to Stripe's terms
• Campaign budgets and fees are non-refundable once a campaign has begun delivery
• We reserve the right to reject or remove sponsored content

8. Intellectual Property

The App, including its design, features, code, and branding, is owned by TopTenify and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written consent.

"TopTenify" and all related logos, names, and branding are trademarks of TopTenify with trademark registration pending. Unauthorized use is strictly prohibited.

9. Termination

• You may delete your account at any time through the App's settings
• We may suspend or terminate accounts that violate these Terms
• Upon termination, your right to use the App ceases immediately
• Provisions that should survive termination will remain in effect

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION. USER-GENERATED RANKINGS AND OPINIONS DO NOT CONSTITUTE PROFESSIONAL ADVICE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOPTENIFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

12. Governing Law

These Terms shall be governed by the laws of the United States. Any disputes shall be resolved through binding arbitration, except where prohibited by law.
